Greece: Smear campaign against Panayote Dimitras for defending migrants' rights

The Observatory has been informed by the Greek Helsinki Monitor (GHM) about the smear campaign in Greek media against Mr. Panayote Dimitras, as well as about the potential criminalisation he faces. Mr Dimitras is the GHM co-founder and spokesperson, and a member of the OMCT’s General Assembly.

On October 10, 2022, Greece’s largest national newspaper Kathimerini, published an article in both English and Greek untitled “The Turkish coast guard and the activist: Trafficking ring with Greek connections”, revealing the alleged involvement of human rights defenders in migrant trafficking into East Aegean Islands.

Using vague descriptions, including “the head of a human rights NGO” or “Greek head of the NGO”, to avoid an explicit mention of Mr Dimitras’ name, the article reveals two criminal investigations and subsequent criminal cases allegedly filed against him and “a national of a Northern European country” on charges of “facilitating the entry of third country nationals into Greek territory" under Law 4251/2014 of Greece.

On July 13 and August 24, 2021, Mr Dimitras alerted the Hellenic Police, the Coast Guard, the Greek migration authorities, the UN Refugee Agency in Greece and the Greek Ombudsman about the arrival of migrant individuals in the Greek islands of Kos and Farmakonisi. Mr Dimitras sent several emails to the above-mentioned authorities listing the names and nationality of the migrant individuals traveling on the boats who wanted to apply for asylum in Greece. In his emails, Mr Dimitras explicitly mentioned that the migrant individuals had contacted the GHM to alert the organisation about their situation, that is, their presence on the islands, as well as their wish to apply for asylum.

However, Kathimerini’s article portrays Mr Dimitras’ legitimate defence of human rights, and particularly, migrants’ rights, as alleged acts of human trafficking. According to the newspaper, Mr Dimitras and the other individual would have cooperated with the Turkish Coast Guard to bring migrant individuals to Greece, by exchanging “information on the time of departure of the journey, the itinerary and the time of their arrival on the Greek islands”. The evidence to prove the involvement of Mr Dimitras into this alleged crime, according to the article, are the above-mentioned emails. The article further mentions that a Cameroonian national and alleged human trafficker traveling on the inflatable boat on July 13, 2021, would have contacted Mr Dimitras on the same day to inform him about the details of the trip. This individual was in fact an asylum seeker who was arbitrarily arrested by the Greek authorities after the BBC published on July 13, 2021 a short report in which the Cameroonian man narrated as an eye-witness and survivor, a previous push-back of migrants in Greek waters.

The investigations into the above-mentioned alleged acts of human trafficking, according to the newspaper, were initiated by the Greek Coast Guard jointly with the National Intelligence Service and were subsequently submitted to “the relevant prosecutor’s office”. The article states that the two criminal cases are at the hands of the investigating judge in the city of Kos. At the time of publication of this Urgent Appeal, Mr Dimitras had not received any summons to a preliminary investigation nor official information about the alleged criminal investigations and cases initiated against him.

The Observatory strongly condemns the smear campaign against Mr Dimitras and all migrants’ rights defenders in Greece, as well as the ongoing denial of rights to migrants and their subsequent exposure to torture and ill-treatment in the context of collective and illegal expulsions.

Non-governmental organisations that work on migrants’ rights play an essential role to defend the human rights of people on the move in a context of systematic violations of international human rights standards by the Greek authorities, including illegal pushbacks and collective expulsions of migrants, as denounced in 2020 by the UN Committee Against Torture (UNCAT).The Greek state has consistently failed to submit the information concerning the alleged intimidation and harassment of human rights defenders and humanitarian workers and volunteers that was required by the UNCAT.

Yet, the situation of migrants’ rights defenders has been critical for years. They have consistently been targeted for their legitimate work and have faced different types of attacks, including surveillance, judicial harassment, smear campaigns, entry bans and expulsion of the country. The Greek investigative authorities often leak alleged criminal investigations initiated against migrants’ rights defenders to the media, creating a climate of fear and a chilling effect among all rights defenders, as documented by the Observatory in its 2021 report “Europe: Open Season on Solidarity”. In several of these cases the human rights defenders have not been informed nor summoned to testify.

The Observatory calls on the Greek authorities to put an end to the ongoing smear campaigns and criminalisation of NGOs and volunteers working in the country in the field of humanitarian assistance to migrants and asylum-seekers. The Observatory further calls on the authorities to guarantee in all circumstances that they are able to carry out their legitimate human rights and humanitarian activities without fear of reprisals.

Please write to the authorities of Greece, asking them to:

1. Guarantee, in all circumstances, the physical integrity and psychological well-being of Mr. Panayote Dimitras;

2. Put an immediate end to all acts of harassment, including at the judicial level, against Mr. Panayote Dimitras, as well as against all human rights defenders in Greece, and particularly, migrants’ rights defenders;

3. Raise awareness and train administrators of justice to refrain from interpreting laws designed to fight organised crime against human rights defenders, organisations or against migrant individuals themselves;

4. Implement General Policy Recommendation 16 of the European Commission against Racism and Intolerance (ECRI) and refrain from criminalising the provision of social and humanitarian assistance to irregular migrants.

IT IS THE GREEK GOVERNMENT’S RESPONSIBILITY TO IMMEDIATELY PUT A STOP TO INFORMAL FORCED RETURNS (PUSHBACKS): THEY ENDANGER HUMAN LIVES AND BREACH THE STATE’S INTERNATIONAL OBLIGATIONS

The way in which the Ministry of Migration handled last month’s case concerning the Syrian people who were left stranded for days in Evros, while sparking a general public outcry, cannot but cause concern and call for reflection. The refugees report, among other things, that they were left helpless on the islet for many days, where a child died of a scorpion sting, and that during their stay on the islet, they were pushed back to Turkiye on at least one occasion.

The Ministry continues to deny the refugees’ allegations and denies responsibility for the case, failing to internationalise the issue (if – as it claims – the islet is not Greek), obscuring the facts and preventing an impartial and thorough investigation. The recent incident in Evros is revealing – and of course it is not the only one – of the fact that the Greek authorities' policy of puahbacksis a standard practice with fatal consequences for the lives, physical integrity and freedom of refugees.

The authorities’ systematic use of misinformation regarding "false reports on pushbacks" aims to cover up illegal practices and to target and put pressure on people and organisations that report these incidents. The fact that on 15th and 16th September, the refugees’ lawyer, Evgenia Kouniaki, was prohibited from entering the Accommodation Facility in Drama, where the Syrian refugees are staying, is indicative of the climate of pressure and the methods used by the Ministry of Migration and Asylum against refugees and their defenders. The recent statement made by the director of HumanRights360, which was received with disapproval by employees of HR360 who publicly expressed their disagreement with the organisation’s director, is also indicative of this climate of pressure and harassment, which brings back unpleasant memories of past times.

This concerted effort by the state to divert attention does not come out of the blue. It is part of the anti-migration policy pursued by the Government and the Ministry, which stubbornly denies that pushbacks are taking place, despite the numerous documented testimonies and reports of Greek and international organisations and agencies.

The incident in Evros highlighted the problem of pushbacks in a multitude of ways. Systematic propaganda and misinformation about these practices, which often result in the loss of human lives, is aimed at concealing the truth, obscuring the consequences (deaths, drownings, violence, etc.) and, of course, at targeting lawyers, organisations, as well as media and journalists who report these incidents. Although pushbacks constitute a systematic state policy, with practices that the Campaign has repeatedly denounced and which have attracted the attention of international organisations and bodies, the institutions of the European Union, with the exception of the European Parliament, continue to show an unprecedented tolerance. The Greek authorities flagrantly ignore the European Court of Human Rights (ECtHR), the multiple applications for interim measures it has granted in the past six months and the 32 appeals currently pending before it, while refusing to respond to the complaints that organised practices, including serious crimes (torture, robbery, endangerment of life), are being carried out at the Greek borders with the aim of deterrence, apparently in the name of “border protection”. y invoking the rationale of “border protection” and fighting a 'hybrid war', the Greek authorities are engaging in a witch hunt that targets the people who seek the Greek state’s protection: refugees, but also their defenders.

We ask the competent Authorities and in particular the Ministry of Migration and Asylum:

▪ To respect the rule of law and comply with the obligations that arise under international law for the protection of refugees, in order to stop the international vilification of the country.

▪ To stop pushbacks, which endanger human lives and are in breach of the state’s international responsibilities.

▪ To stop obstructing organisations that support refugees and to respect their work, refraining from practices that undermine and demonise them.

▪ To stop obstructing lawyers in the performance of their duties and to respect their role, as required by the Code of Lawyers.

To stop slandering anyone who dares to judge the policies described above.

The Campaign for Access to Asylum expresses its full support to the lawyer Evgenia Kouniaki, and denounces the Authorities’ tactics aimed at demonising anyone they consider to oppose them. The Campaign call on the public prosecutor to act with urgency to conduct a thorough and in-depth investigation into the Evros incident, in order to put a stop to the criminal practices of those who put people’s lives at risk, as they are actually responsible for the protection of human life.

The Campaign notes that defending the rights of vulnerable people is enacting the values of our society and as such does not expose but rather honours our country.

Δεν μπορεί παρά να προκαλούν ανησυχία και προβληματισμό οι χειρισμοί του Υπουργείου Μετανάστευσης στην υπόθεση των Σύριων που εγκαταλείφθηκαν στον Έβρο επί ημέρες, τον προηγούμενο μήνα, χειρισμοί που ξεσήκωσαν τη γενική κατακραυγή. Οι πρόσφυγες καταγγέλλουν, μεταξύ άλλων, ότι παρέμειναν αβοήθητοι επί πολλές ημέρες στη νησίδα, όπου ένα παιδί βρήκε το θάνατο από τσίμπημα σκορπιού και ότι κατά τη διάρκεια παραμονής τους στη νησίδα έλαβε χώρα τουλάχιστον μία επιχείρηση επαναπροώθησής τους στην Τουρκία.

Το Υπουργείο εξακολουθεί να αρνείται τις καταγγελίες τους και αποποιείται τις ευθύνες του για την υπόθεση, παραλείποντας να διεθνοποιήσει το θέμα (αν -όπως ισχυρίζεται- η νησίδα δεν είναι ελληνική), συσκοτίζοντας τα γεγονότα και εμποδίζοντας την αμερόληπτη και εξονυχιστική διερεύνηση. Το πρόσφατο περιστατικό στον Έβρο είναι αποκαλυπτικό -και βέβαια δεν είναι το μόνο- για το ότι οι επαναπροωθήσεις είναι πάγια τακτική των ελληνικών αρχών με μοιραίες συνέπειες για τη ζωή, τη σωματική ακεραιότητα και την ελευθερία των προσφύγων.

Η συστηματική παραπληροφόρηση εκ μέρους των αρχών περί «ψευδών αναφορών επαναπροωθήσεων», αποβλέπει στη συγκάλυψη των παράνομων πρακτικών αλλά και στη στοχοποίηση και άσκηση πίεσης σε πρόσωπα και οργανώσεις που καταγγέλλουν τα περιστατικά αυτά. Η απαγόρευση εισόδου στις 15 και 16 Σεπτεμβρίου στη Δομή Φιλοξενίας Δράμας, όπου διαμένουν οι Σύριοι πρόσφυγες, στην πληρεξούσια δικηγόρο τους Ευγενία Κουνιάκη, είναι ενδεικτική του κλίματος πίεσης και των μεθοδεύσεων του αρμόδιου Υπουργείου κατά των προσφύγων και των υπερασπιστών τους. Ενδεικτική του κλίματος πίεσης και παρενόχλησης της δράσης οργανώσεων, είναι και η πρόσφατη δήλωση του διευθυντή της Οργάνωσης HumanRights 360, που επαναφέρει αλγεινές μνήμες άλλων εποχών, ενώ οι εργαζόμενοι στη HR360 με ανακοίνωσή τους, κατέθεσαν δημόσια τη διαφωνία τους με τον διευθυντή της οργάνωσης.

Η πρωτοφανής αυτή θεσμική εκτροπή δεν αποτελεί κεραυνό εν αιθρία. Είναι μέρος της αντιμεταναστευτικής πολιτικής της Κυβέρνησης και του Υπουργείου, που αρνούνται πεισματικά ότι πραγματοποιούνται επαναπροωθήσεις, παρά τις πολυπληθείς τεκμηριωμένες μαρτυρίες και τις εκθέσεις ελληνικών και διεθνών οργανώσεων και οργανισμών[i].

Το περιστατικό στον Έβρο ανάδειξε σε όλες του τις διαστάσεις το πρόβλημα των επαναπροωθήσεων. Η συστηματική προπαγάνδα και η παραπληροφόρηση σε ό,τι αφορά αυτές τις πρακτικές, που πολλές φορές έχουν ως αποτέλεσμα την απώλεια ανθρωπίνων ζωών, αποβλέπει στη συγκάλυψη της αλήθειας, στη συσκότιση των συνεπειών (θάνατοι, πνιγμοί, βία κλπ.) και βέβαια στη στοχοποίηση δικηγόρων, οργανώσεων καθώς και μέσων ενημέρωσης και δημοσιογράφων που καταγγέλλουν τα συγκεκριμένα περιστατικά.

Παρότι οι επαναπροωθήσεις αποτελούν συστηματική κρατική πολιτική, με πρακτικές που η Καμπάνια έχει καταγγείλει επανειλημμένα, και έχουν προκαλέσει το ενδιαφέρον διεθνών οργανώσεων και φορέων, τα όργανα της Ευρωπαϊκής Ένωσης, με εξαίρεση το Ευρωπαϊκό Κοινοβούλιο, συνεχίζουν να δείχνουν μια πρωτοφανή ανοχή. Oι ελληνικές αρχές αγνοούν επιδεικτικά το Ευρωπαϊκό Δικαστήριο Δικαιωμάτων του Ανθρώπου (ΕΔΔΑ) και τις πολλαπλές αποφάσεις ασφαλιστικών μέτρων, που έχει εκδώσει το προηγούμενο εξάμηνο καθώς και τις 32 προσφυγές[ii] που βρίσκονται σε εξέλιξη σ’ αυτό, ενώ απαξιώνουν να απαντήσουν στις καταγγελίες ότι εφαρμόζονται στα σύνορα οργανωμένες πρακτικές που αποτελούν ακόμη και κακουργήματα (βασανισμοί, ληστείες, έκθεση σε κίνδυνο ζωής) ως μέρος των δράσεων της αποτροπής με την επίκληση της προστασίας των συνόρων. Και με την επίκληση της προστασίας των συνόρων και ενός «υβριδικού πολέμου» επιδίδονται σε ένα κυνήγι «μαγισσών» στοχοποιώντας τους ανθρώπους που ζητούν την προστασία του ελληνικού κράτους, τους πρόσφυγες, αλλά και τους υπερασπιστές τους.

Ζητάμε από τις εμπλεκόμενες Αρχές και ειδικότερα από το Υπουργείο Μετανάστευσης και Ασύλου:

§ Να σεβαστούν το κράτος δικαίου και να τηρήσουν τη νομιμότητα και τις υποχρεώσεις τους που απορρέουν από το διεθνές δίκαιο για την προστασία των προσφύγων, ώστε να σταματήσει ο διεθνής διασυρμός της χώρας.

§ Να σταματήσουν τις επαναπροωθήσεις οι οποίες θέτουν σε κίνδυνο ανθρώπινες ζωές και επισύρουν τη διεθνή ευθύνη της χώρας.

§ Να σταματήσουν να παρεμποδίζουν τις οργανώσεις που στηρίζουν τους πρόσφυγες και να σεβαστούν το έργο τους, απέχοντας από πρακτικές υπονόμευσης και δαιμονοποίησης.

§ Να σταματήσουν να παρεμποδίζουν τους δικηγόρους στην άσκηση των καθηκόντων τους και να σεβαστούν το ρόλο τους, όπως επιβάλλεται και από τον Κώδικα περί Δικηγόρων.

§ Να σταματήσουν να διαβάλλουν όποιον/α τολμά και κρίνει τις πολιτικές που περιγράφονται παραπάνω.

Η Καμπάνια για την Πρόσβαση στο Άσυλο εκφράζει την αμέριστη συμπαράστασή της στη δικηγόρο Ευγενία Κουνιάκη, καταγγέλλει την τακτική των Αρχών να δαιμονοποιούν όποιον/α θεωρούν ότι τους αντιλέγει, και καλεί τις εισαγγελικές αρχές με διαδικασίες κατεπείγοντος να ενεργήσουν για τη διεξοδική και σε βάθος διερεύνηση του περιστατικού στον Έβρο, ώστε να μπει ένας φραγμός στις εγκληματικές πρακτικές αυτών οι οποίοι εκθέτουν ανθρώπους σε κίνδυνο, ενώ είναι υπεύθυνοι για την προστασία της ανθρώπινης ζωής.

Και σημειώνει ότι η υπεράσπιση των δικαιωμάτων των ευάλωτων ατόμων είναι υπεράσπιση των αξιών της κοινωνίας μας και σαν τέτοια δεν εκθέτει αλλά αντίθετα τιμά τη χώρα μας.
